High Court Rejects Department of Education’s Denial of Employment to Worker with Criminal Record

The New York State Court of Appeals ruled yesterday that the New York City Department of Education (DOE) acted in an arbitrary and capricious manner in denying employment clearance to a clerical aide because of a 13-year-old criminal record.  MFY showed that the DOE had not considered the employee’s well documented rehabilitation as required by law.
